Terms & Conditions of Sale

Purpose

These terms and conditions of sale ("T&Cs") govern the sale of garden plants and outdoor landscaping materials on the Jardiplants website, operated by Renoday. Placing an order on the website implies full acceptance of these T&Cs.

Products and descriptions

The plants and products offered are described and presented as accurately as possible. As plants are living, natural products, slight variations in appearance, size or color compared to photographs may occur.

Prices

Prices are shown in euros (EUR), all taxes included. Jardiplants reserves the right to change its prices at any time; products are invoiced based on the rates in effect at the time the order is confirmed.

Ordering

Orders are placed online via the website's cart: product selection, cart confirmation, entry of delivery information, then payment. An order confirmation is sent by email once payment is confirmed.

Payment

Payment is made online, at the time of ordering, via our secure payment provider. The order is only considered final once payment has been confirmed.

Delivery

Jardiplants delivers within its service area in Belgium (Walloon Brabant, Brussels-Capital Region, Flemish Brabant). Delivery timeframes and terms are specified at checkout and on the website's Delivery page.

Right of withdrawal

In accordance with EU consumer law (Directive 2011/83/EU), consumers generally have a 14-day period from receipt of the product to exercise their right of withdrawal, without having to give a reason.

However, this right of withdrawal does not apply, or may be limited, for goods liable to deteriorate or expire rapidly, which is the case for live plants. For this reason, the right of withdrawal may not apply to plants that have already been delivered and cannot be returned without risk of damage.

For non-perishable products (landscaping materials, accessories), the standard 14-day statutory right of withdrawal applies under the conditions set out by law.

Returns and refunds

In the event of a non-conforming, damaged-in-transit or incorrect product, please contact us as soon as possible at info@renoday.be with supporting photos, so that a solution (replacement, credit note or refund) can be offered.

Legal warranty of conformity

Jardiplants remains bound by the legal warranty of conformity and the warranty against hidden defects, in accordance with Belgian law, for any lack of conformity existing at the time the product was delivered.

Governing law and disputes

These T&Cs are governed by Belgian law. In the event of a dispute, an amicable resolution will be sought first. Failing an amicable agreement, the dispute may be brought before the competent Belgian courts, or the consumer may use the EU Online Dispute Resolution (ODR) platform or the consumer mediation service.
